PRODUCT SHIPPING AND RETURNS POLICY

 

 

OVERVIEW

 

This Product Shipping Return Policy (“Policy”) applies to all product returns, and supplements and is incorporated by reference into Jomar Distributors, Inc.’s (“Jomar’s”) Terms and Conditions located on our website at http://jomardist.com/terms-conditions/. As used herein, the terms “we,” “us” and “our” refer to Jomar, and the terms “you” and “your” refer to you, the customer. Please read this Policy carefully before purchasing products from us. By purchasing products from us, you agree to be bound by this Policy.

 

SHIPPING

 

Listed product prices do not include shipping and handling charges unless expressly stated, and as such you shall pay for applicable shipment and handling costs. Standard shipments is made via UPS. However, we also offer standard ground, 2 day, or next day delivery options for additional charges. Shipping charges will be calculated when the product is weighed and your address is entered in the UPS system, but before your payment is processed. You are also responsible for any delivery and handling charges, if applicable. We may include any shipping, handling, export licensing or delivery charges on your invoice or bill you separately, and it shall be your responsibility to pay such amounts.

 

We will ship Products to the destination you specify in your order. Unless specified otherwise in the Order (a) Products delivered to locations within the United States will be shipped FOB our shipping point, and (b) Products delivered to locations outside of the United States will be shipped FCA Incoterms 2010. By purchasing products from us, you (i) give your consent for us to arrange for carriage for all Products supplied hereunder on your behalf; and (ii) waive your right to arrange carriage or to give us any specific instructions regarding carriage. We may, in our discretion, make partial shipments and invoice each shipment separately. Orders placed Monday-Friday are normally processed and shipped within a day. Orders placed on weekends or holidays are normally processed and shipped the next business day.

 

Shipping dates are approximate only, and we will not be liable for any loss or damages resulting from any delay in delivery. You may not refuse delivery or otherwise be relieved of any obligations as the result of such delay. If our delivery of a Product to you is delayed due to any cause within your control, we will place such products in storage at your risk and expense.

 

RETURNS

 

You may not cancel or change an order after you accept a quote or issue a purchase order. You may request to return products that are damaged or defective upon delivery, but you must contact Jomar Customer Service within five (5) days after the day you received the products to request a return authorization (“Return Authorization”). We will not accept returns, and no credit will be issued, without a Return Authorization. Products must be returned within thirty (30) calendar days after receiving a Return Authorization and must be in their original containers with the original labels. You agree that any failure to contact us within five (5) days after receipt of the product (“Inspection Period”) or failure to return the product within thirty (30) calendar days after receiving a Return Authorization shall be considered a waiver of your rights to return the product. As your sole and exclusive remedy, upon receipt of products that have a Return Authorization, at our option, we will either issue you a credit for the original purchase price or will replace the damaged product or component. We will have no obligation or liability with respect to any return requests made after the Inspection Period, in which event you will be required to contact the product manufacturer directly, and will be subject to the manufacturer’s warranty and its other terms and conditions.



NON-DAMAGED PRODUCTS

Subject to the preceding paragraph regarding returns of damaged or defective products, all sales are final, and we have no obligation to accept product returns. If we nevertheless exercise our discretion to authorize a product for return, then the product must arrive at our facilities in a condition satisfactory for resale. Any return not due to our error is subject to a restocking charge of 10% of the sale price.

RETURN SHIPPING

We do not credit shipping charges for any returns. Products shipped back to us must be delivered FOB destination if shipped from a location within the United States, and DDP Incoterms 2010 if shipped from outside the United States.

POLICY CHANGES

We reserve the right to change this Policy without notice, provided that the changes shall apply only to purchases made after the updated Policy has been posted to our website. Please check our website for the most up to date Policy. Your continued purchases of our product after our Policy has changed shall indicate your acceptance of those updated terms.
